Standard Mandatory Employee Benefits – Mexico (2025)

For employees based in Mexico under our Employer of Record (EOR) service, the following mandatory benefits are provided in compliance with Mexican Labor Law:

IMSS (Social Security): Covers healthcare, disability, maternity leave, sick leave, and retirement.
Infonavit: Provides access to housing credit benefits.
Christmas Bonus (Aguinaldo): A mandatory year-end bonus, applicable only if the employment extends beyond the initial three-month trial period.
Home-Office Support: In compliance with Mexican Virtual Work Regulations, employees working remotely for more than three months must receive a monthly home-office stipend to cover work-related expenses.
Paid Public Holidays: Employees are entitled to the following official Mexican holidays in the current year:

  • Wednesday, January 1st - New Year

  • Monday, February 3rd - Día de la constitución (constitution day)

  • Monday, March 17 – Natalicio de Benito Juárez (Benito Juárez’s Birthday)

  • Thursday, April 17 – Starting at 3pm PST. Culturally significant holiday

  • Friday, April 18 – Culturally significant holiday

  • Thursday, May 1 – Día del Trabajo (Labor Day)

  • Monday, May 5 – Batalla de Puebla (Battle of Puebla)

  • Tuesday, September 16 – Dia de la independencia (Independence Day)

  • Monday, November 17 – Día de la Revolución Mexicana (Mexican Revolution Day)

  • Thursday, December 25 – Navidad (Christmas Day)

These are the only mandatory public holidays provided for employees in Mexico. This does not mean that employees will also receive U.S. holidays. The decision to grant U.S. holidays in addition to the standard Mexican holidays is entirely up to the client and is not automatically included in the employment package.

If a client requires an employee to work on a mandatory public holiday in Mexico, they must first contact their Account Manager to arrange the corresponding holiday pay rates. This ensures proper compensation and prevents any unexpected charges if the employee is required to work on a holiday without prior notice.

Clients also have the flexibility to enhance the benefits package beyond these legal minimums, depending on their specific needs.
